How to act on this listing · KY

Sheriff / judicial foreclosure sale

Kentucky foreclosures are judicial and sold by the circuit court's Master Commissioner, not the sheriff. You get a commissioner's deed after the court confirms the sale (Jefferson: typically 10+ days after the report of sale is filed). If a redemption right exists the purchaser still receives 'an immediate writ of possession and a deed containing a lien in favor of the defendant' (KRS 426.530(3)). Sold as-is; the commissioner 'does not warrant or guarantee' title (Boone).

Redemption
6 months from the sale, but only if the property 'does not bring two-thirds (2/3) of its appraised value'; the owner redeems by paying the purchase money plus 10% per annum and the purchaser's reasonable maintenance costs (KRS 426.530). County commissioners' FAQs (Jefferson, Boone) describe no redemption when the bid meets the two-thirds threshold.
Deposit
Pay in full at the sale in cash or certified funds, or put 10% down and post a bond with approved surety for the balance (Jefferson, Boone). Jefferson caps cash at $10,000 per purchaser per sale date; no bond is needed if you pay by cashier's check, money order or cash.
Balance due
Balance within 30 days of the sale, with interest on the unpaid balance (Boone: 12% per annum; Jefferson: the judgment rate).
Where
County by county at the courthouse: Jefferson (Louisville) in the Judicial Center jury pool room, 700 W. Jefferson St.; Boone on the front steps of the Justice Center, 6025 Rogers Lane, Burlington, at 9 a.m.
When
Year-round; each county's master commissioner sets its own calendar (Boone updates its sale list every Wednesday).

Watch out for

  • •If your bid is under two-thirds of the court's appraisal the owner gets 6 months to buy it back at your price plus 10% -- bid to the appraisal if you want finality.
  • •Financing the balance means a surety bond and 12%-type interest for 30 days; a cashier's check at the sale avoids the bond (Jefferson).
  • •Objections can be filed for 10 days after the sale (Boone) and the deed waits on court confirmation.
  • •As-is, no title warranty: search for liens and unpaid taxes not named in the action before you bid (Jefferson, Boone).

Due diligence checklist

  1. 01

    Pull a title report

Confirm what liens survive the sale. Many tax sales wipe junior liens but not federal IRS or municipal liens. A title company can run this for ~$50-150.

  2. 02

    Drive by the property

Check occupancy, exterior condition, signs of vandalism, neighborhood comps. You won't get inside before the auction in most cases.

  3. 03

    Have funds ready before bidding

Most sheriff/tax sales require payment same-day or within 24 hours via cashier's check or wire. Pre-approval letters are not accepted.

  4. 04

    Run the numbers

Add holding costs (taxes, insurance, utilities), renovation budget, and selling costs to your max bid. A property at 60% of ARV often needs 30%+ in repairs.

  5. 05

    Talk to a real-estate attorney

Distressed sales in KY have rules that vary by county. A 30-min consult before your first auction is worth it.
