How to act on this listing · FL
Sheriff / judicial foreclosure saleFlorida mortgage foreclosures are judicial and the CLERK of court, not the sheriff, runs the sale. After the sale the clerk files a certificate of sale; if no objection is filed within 10 days the clerk issues a certificate of title (s. 45.031). Sold 'AS IS' with no warranties (Pasco).
- Redemption
- None after the certificate of sale is filed. The mortgagor's right of redemption ends at the later of the clerk's filing of the certificate of sale or the time set in the judgment (s. 45.0315).
- Deposit
- 5% of the final bid, posted with the clerk at the time of sale (s. 45.031(3)). In practice every RealForeclose county requires a 5% advance deposit on account before you can bid (Hillsborough, Pasco).
- Balance due
- Set by each clerk, and short: Hillsborough -- balance plus doc stamps and registry fee by 12:00 p.m. the next business day; Pasco -- by 4:00 p.m. the day of the sale. Missing it forfeits the deposit and the clerk re-advertises (s. 45.031(3)). Final payment by wire, cash or cashier's check; ACH is not accepted for the balance.
- To bid
- Register on the county's realforeclose.com site and fund the 5% deposit in advance (Hillsborough: cash/cashier's check by 4:00 p.m. the day before; ACH needs about 5 business days to clear).
- Where
- Online at {county}.realforeclose.com (RealAuction); s. 45.031(10) authorizes electronic sales.
- When
- Year-round; large counties sell every weekday (Hillsborough: Monday-Friday at 10:00 a.m.). The judgment sets the date, 20-35 days out (s. 45.031(1)).
Watch out for
- •On top of the bid you owe documentary stamps ($0.70 per $100) and the court registry fee (3% of the first $500 and 1.5% of the rest) by the payment deadline (Pasco).
- •A bankruptcy filing can set the sale aside after you have paid; the foreclosure sale fees are not refunded (Pasco).
- •Any party can object within 10 days of the certificate of sale; no certificate of title issues until that window closes (s. 45.031).
- •Fund the deposit the day before -- same-day money does not count, and the balance cannot be paid by ACH.

Due diligence checklist
- 01
Pull a title report
Confirm what liens survive the sale. Many tax sales wipe junior liens but not federal IRS or municipal liens. A title company can run this for ~$50-150.
- 02
Drive by the property
Check occupancy, exterior condition, signs of vandalism, neighborhood comps. You won't get inside before the auction in most cases.
- 03
Check the tax-deed clerk fees
FL requires the winning bidder to pay deed-recording fees + transfer tax on top of the bid. Budget another 3-6%.
- 04
Have funds ready before bidding
Most sheriff/tax sales require payment same-day or within 24 hours via cashier's check or wire. Pre-approval letters are not accepted.
- 05
Run the numbers
Add holding costs (taxes, insurance, utilities), renovation budget, and selling costs to your max bid. A property at 60% of ARV often needs 30%+ in repairs.
- 06
Talk to a real-estate attorney
Distressed sales in FL have rules that vary by county. A 30-min consult before your first auction is worth it.
