How to act on this listing · NJ

Sheriff / judicial foreclosure sale

A sheriff's deed, delivered after the 10-day objection period and payment of the balance. Sales are 'subject to unpaid taxes, assessments, water, rents' and any first mortgage or municipal, state or federal lien (Monmouth), and 'subject to restrictions of record, which are unknown to the Sheriff' (Hudson). As-is, no inspection.

Redemption
10 days after the sale. Rule 4:65-5 bars the sheriff from delivering the deed 'unless a motion for the hearing of an objection to the sale is served within [ten] days after the sale', and the N.J. Supreme Court (Hardyston) held the mortgagor has an 'unqualified right to redeem the property within the ten-day period'; a timely objection extends it, and a bankruptcy filing can extend it 60 days (App. Div. A-1744-23, 2024).
Deposit
20% of the bid immediately at the auction in certified check, cashier's or treasurer's check, or cash (Monmouth caps cash at $1,000; Hudson requires certified or cashier's check).
Balance due
Balance within 30 days of the sale; lawful interest runs on the balance from the 11th day, and no payment is accepted during the first 10 days because that is the redemption period (Monmouth, Hudson).
Bid increment
Not statewide. Hudson County: $5,000 minimum raises until the plaintiff stops bidding, then $2,000.
To bid
County-specific; the successful bidder signs the sheriff's Conditions of Sale acknowledgment at the auction (Hudson).
Where
Each county sheriff, in person: Monmouth at the Public Safety Center in Freehold; Hudson at the County Administration Building, 595 Newark Ave, Jersey City.
When
Year-round, roughly twice a month per county (Monmouth: every other Monday at 1:00 p.m.; Hudson: two Thursdays a month at 2:00 p.m.).

Watch out for

  • •Junior-lien foreclosures sell subject to the first mortgage and all municipal liens; a title search before bidding is the sheriff's own advice (Monmouth).
  • •You cannot enter the property, remove occupants or even pay the balance during the 10-day redemption window (Monmouth, Hudson).
  • •Interest accrues on the unpaid 80% from day 11 until you close within 30 days.
  • •An objection or bankruptcy filed in the 10 days can stretch the deal for months; after 10 days an objection needs a valid ground such as fraud or a price below fair market value (A-1744-23).
  • •Recording the deed and paying transfer fees is the buyer's job (Monmouth).

Due diligence checklist

  1. 01

    Pull a title report

Confirm what liens survive the sale. Many tax sales wipe junior liens but not federal IRS or municipal liens. A title company can run this for ~$50-150.

  2. 02

    Drive by the property

Check occupancy, exterior condition, signs of vandalism, neighborhood comps. You won't get inside before the auction in most cases.

  3. 03

    Confirm the redemption window

NJ sheriff sales may have a redemption period where the original owner can buy the property back. Check with the prothonotary office before paying.

  4. 04

    Have funds ready before bidding

Most sheriff/tax sales require payment same-day or within 24 hours via cashier's check or wire. Pre-approval letters are not accepted.

  5. 05

    Run the numbers

Add holding costs (taxes, insurance, utilities), renovation budget, and selling costs to your max bid. A property at 60% of ARV often needs 30%+ in repairs.

  6. 06

    Talk to a real-estate attorney

Distressed sales in NJ have rules that vary by county. A 30-min consult before your first auction is worth it.
